ALTERNATIVE DISPUTE RESOLUTION (ADR)
Making use of 25 years in the court room, combined with training in the area of ADR, Jim focuses on offering parties an alternative to the expense and time of litigation by serving as a mediator and arbitrator.
The fact he represented both plaintiffs and defendants over the years provides Jim the advantage of knowing the particular interest that each side face in a lawsuit and the considerations in reaching a resolution short of trial.
Training includes certificates from Pepperdine University (recognized as the leading trainer of mediators in the Nation), classes offered by the American Arbitration Association, the San Diego County Superior Court, and San Diego County Bar Association.
Experience includes over 20 years as arbitrator for the San Diego County Superior Court, 10 years for the San Diego County Bar Association Fee Dispute Panel, panel member of the American Arbitration Association for arbitrations and mediations, Settlement Conference Attorney for the San Diego County Superior Court, and private mediations.

Fraud claim filed by multiple homeowners against developer. Obtained a dismissal motion prior to trial, based on failure to timely prosecute.
1998 Welcher et al. v. Mesa Realty.
Represented real estate broker in fraud action brought by multiple homeowners. Defense verdict.
1996 Wrongful death claim against foreign auto manufacture.
Obtained million dollar plus settlement on behalf of decedent's parents. Confidential settlement.
1994 Robinson v. Prudential Calif. Real Estate.
Defended real estate broker. Fraud claim. Defense verdict, resulting in published appellate decision Robinson v. Grossman (1997) 57 Cal.App.4th 634.
1991 Park Villas Homeowners Assn v. Harshbarger Construction Co.
Represented general contractor in construction defect lawsuit. Achieved one of the few defense verdicts for contractor facing strict liability lawsuit in California.
1990 Henry v. Tire Company.
Represented tire retailer that placed four new tires on auto. Two days later tire falls off causing serious personal injury. Defense verdict obtained for defendant retailer.
1989 Trevesani v. Shapell Industries.
Represented general contractor in defect and personal injury claim (mold). Defense verdict. One of the first mold claims to be tried in the United States.
1987 County of San Diego.
Represented County in brain damage auto accident case. Defense verdict for County.
1985 Chubb Insurance Company.
Represented Chubb in subrogation claim. Secured $350,000 settlementagainst several subcontractors for faulty workmanship.
